New York News:

In October 2010 New York became the 50th state to adopt a no-fault divorce policy.  Under the new law, many couples will be able to file for divorce without pointing fingers and laying blame, something lawmakers hoped would make the process of separation less painful for families.  This change is a welcomed development for those using mediation to resolve their divorce.

With no-fault divorce, one spouse simply needs to declare that the marriage is “irrevocably” broken and has been for at least six months.  As long as questions pertaining to child custody, visitation and financial responsibilities have been taken care of, the judge will grant the divorce. With the new change, couples who have grown apart are now given the opportunity to divorce without one being accused of adultery, cruel and inhuman treatment, abandonment or one of the other grounds previously required in divorce cases.
